These Terms of Service (“Terms”) form a binding agreement between you (“you”, “customer”) and Throxxeneaglox, located at Corner Brecon and, Isle Street, Queenstown 9348, New Zealand (“we”, “us”), regarding access to https://throxxeneaglox.world and purchases of Zenovelle and related products. By using the website or placing an order, you agree to these Terms and our Privacy Policy, Cookie Policy, and Return Policy.

2. Eligibility and account integrity

You must be at least eighteen years old and capable of entering a contract to purchase Zenovelle. You warrant that information you supply is accurate and current. You must not misuse the website, attempt unauthorised access, scrape content in violation of these Terms, interfere with security, or use the services for unlawful purposes.

3. Product information and food supplement status

Zenovelle is a food supplement, not a medicine. Descriptions on the website are for general information. Individual experiences vary. The website does not provide medical advice. Consult a qualified clinician for questions about diet, medicines, or conditions. Product images are illustrative; packaging may differ from photographs where manufacturers update design.

4. Orders, acceptance, and contract formation

Submitting an enquiry or checkout step does not alone create a binding contract. We may accept or decline orders for legitimate reasons including stock availability, pricing errors, suspected fraud, export restrictions, or failure to verify identity. A contract is formed when we send you a clear order acceptance by email or other durable medium. We may cancel orders before dispatch where we cannot fulfil them; in that case you will not be charged, or we will refund amounts already taken.

5. Price, taxes, and currency

Prices are displayed in New Zealand dollars (NZD) unless otherwise stated. They include GST where we are required to charge GST on domestic supplies. International customers may be responsible for import duties, taxes, and brokerage charged by customs authorities; those amounts are outside our control. If a price error is obvious and could reasonably have been recognised as a mistake, we may refuse or cancel the order and refund any payment.

6. Payment

We use third-party payment processors. You authorise us and our processors to charge your selected payment method for the total including applicable shipping. You represent that you are authorised to use the payment method. We do not store full payment card numbers on our servers when processing is delegated to certified providers. Chargebacks initiated without first contacting us may result in account restrictions where repeated abuse occurs.

7. Shipping and risk

Delivery timelines are estimates. Risk of loss passes to you upon delivery to the address you provide or collection by the carrier as evidenced by tracking. You are responsible for providing a safe delivery address. If a parcel is returned as undeliverable, we may charge reasonable reshipping fees or cancel the order in line with our Return Policy.

8. Consumer guarantees and liability

New Zealand consumers have rights under the Consumer Guarantees Act 1993 where goods and services are acquired for personal, domestic, or household use. Nothing in these Terms excludes or restricts those non-excludable rights. To the maximum extent permitted by law, our aggregate liability arising from any order is limited to the amount you paid for that order, except for liability that cannot be limited by law. We are not liable for indirect, consequential, or punitive damages, loss of profit, or loss of data except where prohibited.

9. Warranties disclaimer

Except as required by law, the website and content are provided “as is” without warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant uninterrupted or error-free operation.

10. Intellectual property

All website content including text, layout, graphics, and trademarks belonging to us or our licensors is protected. You may not copy, modify, distribute, or create derivative works without prior written consent, except for temporary caching necessary to browse or as allowed by applicable mandatory exceptions.

11. User content

If you submit reviews, testimonials, or other content, you grant us a non-exclusive, royalty-free licence to use, reproduce, and display that content in connection with marketing and product improvement, subject to our Privacy Policy. You confirm you have the right to grant this licence and that content is truthful, lawful, and not misleading, including under applicable advertising and consumer rules.

12. Prohibited conduct

You must not: infringe intellectual property; upload malware; harvest data without consent; impersonate others; engage in fraudulent orders; or circumvent technical measures. We may suspend access where we reasonably believe a breach occurred.

13. Third-party services

Our website may integrate tools operated by third parties. Their terms and privacy notices govern those tools. We are not responsible for third-party failures beyond our reasonable control.

14. Force majeure

We are not liable for delay or failure caused by events outside reasonable control, including natural disasters, pandemics, war, strikes, supplier failures, or infrastructure outages.

15. GDPR and international customers

If you are in the EEA or UK, our processing of personal data is described in the Privacy Policy. These Terms do not limit mandatory consumer or data protection rights applicable in your country.

16. Fair Trading Act 1986 and Fair Trading practices

We comply with the Fair Trading Act 1986 in New Zealand, which prohibits misleading and deceptive conduct in trade. Product statements on the website are presented carefully and are not intended to mislead. If you believe any statement is unclear, contact us for clarification before ordering.

17. Customs, export, and restricted substances

You are responsible for ensuring that Zenovelle may lawfully be imported into your country. We may refuse or cancel orders where export or import would violate sanctions, embargoes, or product classification rules. Ingredient lists are provided so you can verify local requirements.

18. Assignment

You may not assign your rights under these Terms without our consent. We may assign our rights and obligations to an affiliate or successor in connection with a merger or sale of assets, provided your contractual position is not materially worsened.

19. Disputes and jurisdiction

Parties will first attempt to resolve disputes in good faith through contact with our support team. If unresolved, New Zealand courts have non-exclusive jurisdiction and New Zealand law applies, without regard to conflict-of-law rules that would apply another jurisdiction’s law, except where mandatory local consumer rules require otherwise.

20. Changes

We may amend these Terms. The updated version will be posted with a new “Last updated” date. Material changes to terms affecting existing orders will be communicated where reasonable. Continued use after changes constitutes acceptance except where prior notice and consent are required by law.

21. Severability

If any provision is held invalid, the remaining provisions remain in effect.

22. Entire agreement

These Terms, together with the policies linked above, constitute the entire agreement regarding the subject matter and supersede prior inconsistent understandings, except for fraudulent misrepresentation.
